The diploma thesis „Trust in the Czech Republic“ deals with new institute in Czech law legislation. The first part is focused on theoretical knowledge of the Trust Fund, it is history and similar institutions based abroad. The second part deals with the process of establishment of the Trust and show methodical instructions for the system of taxation of income related to the operation of the Trust Fund.

The main goal of this graduation thesis is to gather a sufficient amount of information, pictures and literature related to the life and personality of Karel Nedobitý in order to reflect on his interests and his influence on athletics evolution in České Budějovice. The thesis is mainly divided into a part devoted to the running career of Karel Nedobitý and then functional part. At the end, the author focused on literature and awards received during his life. Most of the thesis is written from information obtained in the archives of the Research Library of South Bohemia in České Budějovice. The author describes in detail the life of Karel Nedobitý almost every year during his work in athletics.

The Introduction of Trusts in the Czech Republic

Complete recodification of the Czech Civil Code among other changes establishes trusts, a very flexible tool which can be used by both natural and legal persons. Countless possibilities for the utilisation of trusts range from charities through intergenerational transfers of property or pension securitisation to the managing of a corporation and investment activities. The core of this paper is an analysis of three basic elements of trusts: the description of trusts, monitoring and analysing of the contemporary development, and perception of trusts by Czechs. The thesis contains detailed description of rights and duties of the settlor, the trustee and the beneficiary, also compares the Czech and foreign processing and then points out some differences and offers various recommendations. A fully processed questionnaire survey and analysis of the collected data is an integral part of this work. Low literacy about trusts has been discovered and its impact has been assessed. The survey results demonstrate the necessity of establishment of competitive conditions together with fighting negative perceptions towards trusts. The investigation further revealed important as well as unimportant features of trusts to potential settlors. These findings could be significant for the future development in this area....

Fiduciary in comparative context Abstract In this doctor thesis, the author is focused on explaining the historical context of the trust institute development, followed by comparison between jurisdiction in England, Lichtenstein, France, Germany and the Czech Republic. The author also points out differences between traditional common law and continental law systems. Even though the differences between local systems are quite significant, the trust system is gaining popularity across the countries for its flexibility of asset management. Just as the Quebec trust was inspired over time by the adjustment of the trust according to common law, the Czech legislator should proceed to amend the individual provisions of the trust fund so that its usability is as wide as possible. A different way from traditional common law has emerged in Germany, where Treuhand was created with German law leaving a wide margin of discretion and the codified part is a minority, as is the case with the French fiduciary. The great differences between the national regulations of trusts or trust-like institutes necessarily lead to the question of whether it is not appropriate to make certain legislative improvements. The submitted thesis deals with a new area of Czech law - (Czech) trust, incorporated into the Czech legal system by the new Civil Code. The thesis builds on the Czech legal literature, commentaries and articles, as well as on the available sources on trust of the Canadian province of Quebec, which was essential inspiration for the Czech law. It provides an insight into the everyday functioning of a trust and the complex legal relations among the persons involved. It also includes a short overview of the types of trusts which cannot be created or imposed in the Czech Republic but are known in common law countries. From the perspective of a proposed amendment, it further discusses the future of the (Czech) trust, above all, the issue of whether it should be subject to registration. This rigorous thesis is focused on a status of trust in an application practise in a Czech legislation with a context of historical aspects of institutes similar to trusts as well as actual legislation. The thesis includes also analyses of more difficult provisions concerning the trust, including economic impacts representing accounting and tax consequences. Also comparison with established modifications trusts in Europe and their possible utilization of the Czech point of view of the settlor is not ignored in the thesis. The first chapter describes the historical elements related to the Czech trust, particularly fiducia and trust. It highlights a faith as an essential element of this institute. Continental legal system based on ancient fideicommissum was probably the foundation of Anglo-American concept of trust. The second chapter is considered trusts in the Czech countries, containing legal aspects starting from the High Middle Ages to a contemporary reflection in the Civil Code. The substantial part of the thesis is about a detail analyze of the contemporary legislation pointing out some difficult questions (as misleading the trust) and possible problems. There are also de lege ferenda commented possible corrections of the actual legislations, not only reflecting an amendment of the Civil Code....

A method for building an IT startup company

The present thesis focuses on founding and evolution of information technology startups. Special attention is given to the personality of the founder and the options of financing a startup in the Czech Republic. A survey among the students of the University of Economics, Prague regarding the general awareness of the issues related to the founding of a startup and the main obstacles to it is an integral part of the thesis. The main contribution of the thesis is a method for building up the IT startups, which may serve as a hand-book for potential future founders. As a secondary contribution, this thesis serves as a compact overview of the issues related to startups, especially to the person of the founder and financing possibilities in the Czech Republic.
